The Strangling Of American Hospitals

That is what is happening in many of the smaller Hospitals in the United States these days.  So it is being reported by Dr. Thomas M. Hamilton MD, better known as The Grouch.
We had staff meeting yesterday at the hospital. A topic of discussion was RAC audits and a specific case affecting our hospital.

If you don't know what RAC audits are, do a Google Search on it and read about it for yourself. I betcha most of you have never heard of such a thing.

Anyway, I felt compelled to write my Congresswoman, Marsha Blackburn, and my two Senators, Bob Corker and Lamar Alexander over this issue. I know I'll probably get the standard form reply, but it made me feel better anyway. Here it is:
Dear Senator/Congresswoman:

I feel the need to make you aware of the serious situation created for small hospitals under the RAC (Recovery Audit Contractor) program created by Medicare.

I am a physician at our local hospital. During staff meeting yesterday, we discussed a situation concerning a recent surgical case. A patient had a lesion surgically removed. The doctor’s note read as follows, “an eleven blade scalpel was used to remove the lesion”.

The RAC auditor reviewed this chart and stated that the note should have read, “an eleven blade scalpel was used to EXCISE the lesion”.

Because the word REMOVE was used instead of the word EXCISE, the RAC auditor declared that the hospital should refund Medicare an amount of $11,000. The hospital appealed and pointed out to the auditor that there was essentially no difference in the words EXCISE and REMOVE. To no avail, the auditor stated the hospital owed Medicare $11,000.

Senator/Congresswoman, these RAC audits are an exercise in pure lunacy. I hope you can see the obvious stupidity imposed on hospitals by the intrusion of the United States Government by this example above. I would also hope that you would take steps to relieve us of the burden of these nonsensical RAC audits. If you don’t, many hospitals like ours simply will not survive and will end up closing the doors.

It is my understanding that the bureaucrats involved in the RAC audits are entitled to a third of the funds they recover from hospitals. So out of that $11,000 dollars they are squeezing from our hospital over the definition of a single word, the auditors themselves stand to collect $3666.66 for themselves. Senator/Congresswoman, can you truly believe that hospitals will be treated fairly under such a system? If a private entity conducted itself in a manner similar to the RAC auditors, the people in that entity would be jailed.

Of course if Barack Obama has his way we will end up with single payer health care for all which will no doubt be broke like Social Security and Medicare. More and more hospitals will close. So much for universal health care.

Right now our hospital makes about 46 cents for every dollar billed to Medicare. We make 24 cents for every dollar billed to Tenncare (Tennessee Medicaid). I am told under the proposed Medicare cuts and RAC audits we can see our reimbursement fall to 32 cents for every dollar billed to Medicare. You can see we are slowly but surely being strangled by Uncle Sam. Our doctors, nurses, and other hospital staff work hard to provide health care to some very old and very sick people. We deserve honest payment for our efforts rather than a bunch of shenanigans invented by Medicare designed to avoid payment.

Senator/Congresswoman, I implore you to look into this thing called RAC audits. Talk to your constituents in the health care field. They will tell you the same thing I am telling you. We are being strangled by this government nonsense.

I am looking for a personal and thoughtful reply from you on this matter, not the usual form reply provided by a staffer.

I find it troubling that the "auditor" receives a "reward" of 1/3 of all monies collected, thus discouraging a true audit of books since it is in the auditor's best interest to "find" fault in every search.

Thus the word Excise, meaning to cut out or off, as a tumor. And the word Remove, meaning to take away, withdraw, or eliminate is not considered equal in intent.  This auditor has taken it upon his/herself to become the standard exemplary of the English Language.

This is only one example of what is happening now and will happen when Obamacare is implemented in its full force.

Is it no wonder that thousands of doctors are planning to leave the profession.  Where will the government find their replacements?


Will a doctor trained in one of those nations instill confidence in you?

How Obama's Health Care Funds Abortions: Stupak's Abortion Bait and Switch

Most of us didn't question Rep. Bart Stupak's (D-MI) commitment to unfunded taxpayer abortions - especially after he talked about it for days, but shame on us. We should have known better. These are Democrats, and they know not of principled commitment. But it was not just Stupak who chased after a way to vote for the bill. In fact, in the end, Stupak was of no concern to Nancy Pelosi. She had cut bait and moved to more lucrative waters - a coalition of about 30 Democrats who late on March 19th worked a deal to support their regional areas - mainly the hospitals, and they didn't care about abortion. Neither did most Democrats, despite the lies Stupak boldly spoke to the Nation.

Republicans asked for a "motion to recommit,"...language similar to Stupak's, ensuring no public funded abortions, be added to the bill before voting. That was not going to happen, even though Stupak knew the President's Executive Order was worthless.  See the roll call vote on the motion here. From the floor of the House, just before the vote on the Senate health care bill, Stupak called the Republican "motion to recommit," "disingenuous," and said this:
...it is the Democrats who have stood up for the principle of no public funding for abortion," he said on the House floor, 
Only 64 Democrats voted for his amendment. All but one Republican voted for the amendment. It was only due to Republican votes that Stupak's amendment made it into the bill. Henry Hyde, the author of the Hyde amendment was a Republican. Talk about "disingenuous." The myth of Pro-Life Democrats exposed. See this in the first video below.

But Rep. Stupak never planned to vote against health care, regardless of taxpayer funded abortions. In the second video from last Fall, at 1:29 minutes in, he tells constituents that if he has to accept federally funded abortions to have Democrat health care, he will do so, and still stay true to his principles. Hear the audience's abhorrent reaction.

So, who do we believe? Is there language in the Senate bill that allows for taxpayer-funded abortions?  Here is the explanation:

In this video, Stupak explained why the Hyde amendment did not apply to the Senate bill:
 [Senate legislation] is not subject to the annual appropriations law and therefore is not subject to the Hyde provisions contained in the annual labor HHS bill. The only way to provide Hyde protection of no public funding for abortion in the health insurance option and subsidies in the form of affordability credit found in the bill is to insert the Hyde amendment into this legislation...
This from the United States conference of Catholic Bishops further clarifies: the key is that the new monies in the bill, are not appropriated by funds restricted by the Hyde amendment:
The Senate bill authorizes and appropriates billions of dollars in new funding -- outside the scope of the appropriations bill covered by the Hyde amendment...These funds are new, and over he next five years they will be provided without being appropriated in the Labor/HHS appropriations act; therefore they are not covered by the Hyde amendment, which says only funds "appropriated in the Act...may not be used for elective abortions.

On Sunday the Democrat controlled House of Representatives will pass the abomination known as Obamacare.  No matter what the people of this nation think or say.  I do believe that this nation is heading down on a course that will lead it towards another Civil War.  There is only so much destruction of the values of this nation, the wanton ignorance of the will of the people, and the open contempt of the Constitution that their anger will not be contained.

The great danger in historical revisionism is the potential for future generations to make the same mistake. Abraham Lincoln and Franklin Delano Roosevelt were no friends to the US Constitution, but few Americans know this fact. Even more egregious is the dearth of Constitutional knowledge in America. However, that is changing, which does not bode well for the Obama Administration.

Never in our country’s history have Americans witnessed the travesty of such an anti-constitutional administration and congress. And a great deal of the responsibility falls on both major political parties and the media. However, there are others, including American voters who refuse to intelligently discuss the issues and critically analyze what the administration is doing. As a result, the likelihood of another civil war or second revolution increases with each passing day and each new power-grab by the Obama administration.

This past week, while garnering the largest market share of any news media outlet, Glenn Beck painstakingly analyzed what the Obama administration is really all about and what it is actually doing. There hasn’t been one White House denial. At the end of the week, Beck presented five questions Americans should ask their politicians. Questions based in our Constitution. Glenn suggested in the strongest terms that Americans ask their political representatives each of the questions and then following-up with the question “Are you in or out?” And if the representative is not on board with the questions, then Americans need to vote them “out” in the 2010 elections.

Although I completely concur with Mr. Beck with respect to his analysis of this administration and the previous one (Beck is no fan of Bush spending, etc.), there are a plethora of reasons America will not make it to the mid-term elections in 2010. The analysis of this potential reality and a possible scenario follows.

The Coming Armed Revolution: Can it be avoided? If not, are you in or out?

Barack Obama, Rahm Emanuel, Reid, Pelosi, Van Jones, and a host of others are making a mockery of our Constitution — and the American people know it.

People are not buying these concepts that are completely foreign to America. We’re almost reaching a revolution in this country. -- Senator Jim Inhofe

Currently, there are admitted radical Communists serving as Obama’s “czars,” a congressional bill to allow Obama seizure of the internet, and the administration is responsible for nationalization of industry and a blatant attempt to nationalize health care. The Obama administration is engaging in generational warfare and Obama-supporting union members have attacked US citizens participating in Town Hall meetings. There are provisions in Obama’s health care overhaul bill that contain loopholes that will result in health care benefits to illegal aliens, and ACORN registers illegal aliens to benefit the current administration. The government vilifies citizens, talks of mandatory H1N1 vaccination, and federal tax dollars pour into organizations to enable voter fraud. There is an immoral leftist boycott of one of the world’s most socially-conscious companies occurring, and the Democrats have been involved in silencing critics through physical intimidation, lawsuits, refusal to air commercials, and slander — and the list goes on.

To say the majority of Americans are upset about the country’s direction would be a gross understatement. They are pissed-off and willing to take up arms.

The thought of Americans engaging in armed revolt was unthinkable 12 months ago. After SEIU thugs beat-up a man attending a Town Hall meeting, other Americans showed-up at Town Hall meetings armed with semi-automatic weapons — including a meeting the president attended. There hasn’t been a union “beat down” of a Town Hall attendee since. The message is clear: Tyrants and bullies can be dealt with, even if it’s at the “business end” of a firearm.

Although the federal government is monitoring a number of known militia groups, these groups are not a threat to the government. The current threat to the federal government is the average American who realizes the federal threat to his personal freedoms and to his children’s freedoms and financial solvency. Americans are furious. They are not just angry. Moreover, many realize it may take the forcible removal of the Obama administration, as well as its direct and tacit supporters on both sides of the aisle, to restore our freedoms and sanity to Washington. Therefore, what follows is a “potential” scenario, which in no way should be construed as advocating an armed revolt against the federal government.

We have a weak fool for a President who shows contempt towards the American people.  We have a Congress that best is described as a worthless man (John Adams).  In refusing the to follow the will of the people they are imposing the will of the elite on the majority.  Not the way our government is suppose to work.

e placed The Holy Suit and Tie once again upon His body, and ascended once again to the Dome.  There the assembled chapter of the Congress, the Holy Justices of the land, the members of the anointed Cabinet and guests from near and far sat awaiting His words.  Unlike the year before, He wasn't popular.  Every plan, every idea He had, was rejected by the people.

"We do not want your Cap and Trade, Health Care, or other Moonbat ideas.  Your bowing down to dictators, despots and tyrants around the world does not put us at ease You have apologized to everyone for all the supposed evils that we were suspected of doing.  You are getting ready to destroy our laws, by declaring the Holy Document invalid.  We have heard enough lies from you, your dogs Emanuel, Axelrod, Pelosi and Reid.  We've heard them all and we've learned a couple of things."

The Anointed One just smiled and then addressed the Nation:

short year ago I took office, but that is just a breeze in time.  Look back upon our Founding Fathers, our struggles during the Civil War, the Depression.  We did not flounder or despair.  Nor did we despair through out the struggles of the Civil Rights Movement.  And I will not despair now.

For I inherited a bad economy that was shaken to its core.  I opposed all of the bailouts done, for I saw the harm they will do.  My stimulus plan has created jobs in teaching, rescue, construction and other sectors.

We need Health Care now!  I demand Congress to pass.  Cap and Trade too.  Forget about the Holy Document.  There is too much to do.

I am a man of the people, representative of the Middle Class, My values are the same as yours.  I love this country so much I would never bad name it.  But we did wrong with the Muslim world, and other places too.  I said to them I am sorry, there is nothing you can do.

I said I would create jobs, and that I will do.  For every man and woman.  New industries, new factories, Red, White, Blue, and Green.  We must compete with China, Korea, and Germany too.  This we must excel in if we are going to continually survive.

I will eliminate the nukes of the world, starting with our own.  For did not the Great Reagan of old try to achieve this very goal.

People through out the land write to Me with their problems.  A businessman in Denver*, or in Philadelphia, a teacher in the city, the cop on the beat, a child who wants to know why Mommy and Daddy lost their jobs, another who just lost his home.  I read all their letters, I know all their problems, and I will solve them all.

I could go on all night, but that will do no good at all.  I promised you Hope and Change, and did not lie to you on that, for I am not President #43.

And after The Anointed One had finished His speech, His  followers were full of glee.  For they just knew that once again He had saved the day.

But from right across the river, from the city of Richmond in the land of Virginia, came a new prophet from the right.  Bob The Wise McDonnell.
The Prophet spoke of those with a job, how 1 in 10 lost theirs.
He spoke of the despair the nation felt, of how the economy  was gone.
He spoke of the need for smaller government, how The Anointed One did spend.
He said that the time for spending cuts and freezes were last year, not when your polling number has shown you have failed.

The Prophet McDonnell told the people that it isn't too late.
That the time has come to sit and wait,
So The Anointed One could not shove His agenda down our throats.

He told the assembled people and media the truth.
And our solutions aren't 1,000-page bills that no one has fully read,
After being crafted behind closed doors with special interests.
In fact, many of our proposals are available online at solutions.gop.gov, and we welcome your ideas on Facebook and Twitter.

He told them this and more.
 And through it all, the world went on, the nation will endure.

The GOP got Teddy's seat, they can get more they will.
For the people have seen the truth, heard the lies and broken promises.
Unlike those on the left, the right will not just yell.
They are the ones, in Midterm years, come out in droves to vote.

Reid, Frank and Boxer, plus many more are running scared tonight.
For the GOP has the will, the drive and the clout,
To drive the Moonbats back into the dark.

We just have to wait for November to do it!


*  The President mentioned many people in his speech, but none by name, nor did he recognize any of them in the balcony (he only recognized his wife).  Could it be they are all named:  Ellie Light?

The Awakening!


Book of Obama Chapter 9

All through the first year of The Anointed One the people of the land did grumble.
"You are spending too much!"
"Increasing the debt!"
"The jobs are gone, make more!"
"The banks will fail again!"
"The car companies will fail!"
"HEALTH CARE!"
And did The Anointed One listen to the people of the land?  No He did not.  For He was told by Pelosi the Loud and Reid the Inept that they can do what they want, for the people will forget.

So while all through the Summer of Discord,. while tempers ran wild, The Anointed One just plowed forward with His own New Deal.

"We will push it through Congress!" The Anointed One shouted to His staff.  "We will force this on the people."  And the Progressives did laugh.

"We will change the nation, turn it into Europe-lite.  By the time We are finished, those idiots in the street will not be able to change it back."

"For Nanny is the name of the New Welfare Plan.  Total Cradle to Grave, We will do to them as well.  I know best, that everyone can see.  My way is the Right Way.  That is what I say it will be!"

All through the summer and into the fall, the warning signs were there for all to see, but The Anointed One became blinded to the truth.

He ignored the disaster of the Olympics, how His city of Chicago was turned down.  Or when He went to campaign for Virginia and Jersey of New, He couldn't turn those races around.

He put on the tears for the victims of Fort Hood, but refused to call it terror.
He ignored the Christmas bomber, it upset His plans for golf and fun that week.
But when His friend's son received a boo-boo, He ran back as fast as He could.
He partied day and night in the warm Hawaiin sands.

But on the eve of His first year anniversary.  He has received the worst news.
The Fiefdom of the Kennedy's:  Massachusetts has left the color blue.
The Fiefdom that old Joe the Bootlegger bought for his own son.  A piece of land that was the birthplace of the progressive slant.
The land of Harvard (the school The Anointed One attended.), of Barney the Frank and Kerry the Swiftboater, plus other illustrious names.
The Fiefdom of John the Martyr and Teddy the Lecher, both of Camalot fame, did hold court.  Those names plus Tips, remained true in count.

Yet of the day before the anniversary of the anointing by John of Roberts, the Holy Chief of Justice, where He was endowed with the Mantle of Power, did the news break unto Him.  His party just lost the Fiefdom of Massachusetts, and may never get it back.

There goes the New Deal for the Nation.  The Nanny must go!  The people have turned against us.  Our seats will be given to another.  The people have spoken in Massachusetts, a Fiefdom so blue it was nearly black.  The Kennedys don't run this Fiefdom any more.  The people have taken it back!

"We are fed up with your nanny, spending and lies.  You promised us openness on C-SPAN!  You said no smoke-filled rooms, transparency.  Yet you haven't delivered these.  What we want is good government.  Lower taxes, more jobs, less waste, less debt.  We didn't get that.  We want to feel safe when we fly.  Yet we don't feel safer too.  You treat those who cause harm to us like the common criminal.  Giving them rights they are not entitled to, setting them upon our shore.

For all these reasons and more, we have chosen our new champion Brown of the Body Politic.  He is our champion.  He is our Redeemer!"

The Anointed One reeled in horror.  He was the chosen.  He wore the Mantle of Power.  He was the one they had to worship.  He would see to it that the people would have this nanny nation to live on.

But it is too late for the false Messiah He has become, His oration will fail.  For the people of the nation have awakened.  Now they will just count the days to the next election where they can correct the mistake they made in 08!

Reid's Moment Of Truth




It has finally been announced!

After weeks of negotiations.
After weeks of protests.
After weeks of bickering within the Democratic Party.
After shutting out the Republicans from having any voice.

Senator Harry Reid (D-Nevada) is decending upon the  Senate, like Moses, bearing the long awaited changes to the Senate version of the Healthcare bill.
Emerging from marathon talks with Majority Leader Harry Reid and White House officials late Friday night, Nelson said "real progress" had been made toward his call for greater restrictions on abortion within the legislation.


Majority Leader Harry Reid decided to unveil a final package of changes in the long-debated legislation on Saturday "and is confident that it will prevail," his spokesman, Jim Manley, said in a late-night statement.

Reid made no comment to reporters, but Sen. Chuck Schumer, D-N.Y., another participant in the talks, sounded pleased. "I've been in Harry Reid's office for 13 hours and I'm glad to get out of there," he said. "But I'm particularly glad with what has happened in that office."

With Nelson's vote, President Barack Obama's Senate allies would have the 60 needed to overcome a filibuster by Republicans.

That gave Nelson enormous leverage as he pressed for concessions that included stronger restrictions on abortions to be covered by insurance policies offered in a newly overhauled health care system. Officials said he was also seeking to ease the impact of a proposed insurance industry tax on nonprofit companies, as well as win more federal funds to cover Nebraska's cost of treating patients in Medicaid, the state-federal health care program for the poor. These officials, speaking on condition of anonymity because of the sensitivity of the talks, said the administration and Democratic leaders had offered concessions on those points.

The Nebraska Democrat has already rejected one proposed offer on abortions as insufficient, and the presence in the talks of Sen. Barbara Boxer, D-Calif., indicated additional changes were on the table.

The legislation would expand coverage to 30 million people now uninsured and try to curb rising health care costs. Insurance companies would be prohibited from denying coverage to people with health problems, or charging them more. All Americans would be required to have health insurance, or eventually face fines. The nearly $1 trillion, 10-year cost would be paid for mainly with Medicare cuts and new taxes on insurance companies and other parts of the health care industry.

The week saw an intraparty brawl among Democrats, with liberals seething over the compromises Reid has already made to keep the bill moving.

Gone is a government insurance plan modeled on Medicare. So is the fallback, the option of allowing aging baby boomers to buy into Medicare. The major benefits of the bill won't start for three or four years, and then they'll be delivered through private insurance companies.

Oh happy day!  A compromise that leaves out 35 million Americans, will cost over $1.5 Trillion (That is Trillion with a T), will start to tax everyone immediately, won't provide any coverage for 3 to 4 years, and is unConstitutional.

Other than all those reason, it is a wonderful plan.

Just wait until the House gets it.  Without the public option or increase of Medicare, it won't stand a chance with Pelosi.

But it will get the votes by Christmas.  Just do you think that the Members of Congress will get the votes next November?

Senate Health Care Bill Unconstitutional

While we know in our gut this massive piece of legislation coming out the Senate, and said to be a health care bill, is unconstitutional, most of us cannot concisely explain the unconstitutionality of it, and why those seeking to pass it should be strung up, tarred and feathered. The Heritage Foundation has done the hard lifting for us.





Congressional Health Care is UnConstitutional

Assuming a bill is passed, and assuming the information so generously provided by the Heritage Foundation is sound, which I believe it is, then the legislation must get in front of the Supreme Court if we are to be rescued from the unconstitutional grasp of Congress...and their unlimited power in the future, once they have forced this upon us.

The argument that mandated health care is no different from mandated auto insurance is everywhere. It is the single most relied up argument among bloggers to support ObamaCare. That issue is addressed in 'D' below.

Those of you who read my blog know I sometimes take issues that are complex to me and cull them down in the form of a post. That's what I've done here. I encourage you to read the original or the many, many pertinent details I have omitted, but hopefully not misconstrued. My disclaimer is: read the original if you want to know you're getting it right.

From the Heritage Foundation, along with my conversation thrown in:

A)  The Constitution does not grant Congress the power to mandate that an individual enter into a contract with a private party or purchase a good or service. Nowhere is this in the Constitution, and contrary to the opinion of Congress, the power is not given under The Commerce Clause, as Nancy Pelosi claims. Remember this:
When Nancy Pelosi was asked where the Constitution authorized Congress to order Americans to buy health insurance, she dismissed the question by saying,

“Are you serious? Are you serious?”

According to CNSNews, her press spokesman said that this authority comes from Congress’s “constitutional power to regulate interstate commerce.”
Pelosi and others claim that the Commerce Clause "jurisprudence" leaves "no doubt" that the mandated insurance requirement is a constitutional exercise of that power. "They are wrong."
The Commerce Clause, set forth in Article I, section 8, grants Congress the authority:
"[t]o regulate Commerce with foreign Nations, and among the several States, and with the Indian tribes."
The Congressional Research Service has acknowledged that the mandate for individuals to buy health insurance or be subject to a tax or fine, may not be constitutional:
...it is unclear whether the clause would provide a solid constitutional foundation for legislation containing a requirement to have health insurance.
Whether such a requirement would be constitutional under the Commerce Clause is perhaps the most challenging question posed by such a proposal, as it is a novel issue whether Congress may use this clause to require an individual to purchase a good or a service.
The above is contained in a report by the Congressional Research Service, written by Jennifer Staman and Cynthia Brougher for Congress.

The Heritage Foundation points out that these words above: "it is a novel issue," means that it is "unprecedented." There is no previous legislation or judicial opinion to support this "unprecedented" legislation (mandate, demand on an individual person).

B) The only avenue for Congress to gain this power, is for the Supreme Court to create a new constitutional doctrine. Because the mandate is unprecedented, the Heritage Foundation believes it unlikely that the Supreme Court will "stretch the commerce power even further than it already has," "even under the most expansive readings" already given by the Supreme Court," this power does not fit into the "class of activity" needed to be constitutional.

C) According to the Supreme Court, "Congress has the power to regulate three categories of activity pursuant to the commerce power:"
(1) Congress may regulate the "channels of interstate or foreign commence". This includes the regulation of steamship, railroad, highway or aircraft transportation.

(2) Congress may regulate and protect "the destruction of aircraft, or persons or things in commerce. An example is "thefts from interstate shipments."

(3) Congress may regulate economic activities that "substantially affect interstate commerce.
Mandating individual health insurance must fall into one of the three categories of regulation above. The first two are not a possible fit, so the mandate must fall into (3) to be constitutional, and Congress is asserting that (3) is precisely the mechanism that gives them the power they want.

The Heritage Foundation says:
The Senate bill asserts (erroneously) that: "[t]he individual responsibility requirement...is commercial and economic in nature, and substantially affects interstate commerce.... The requirement regulates activity that is commercial and economic in nature: economic and financial decisions about how and when health care is paid for, and when health insurance is purchased.
The question of "what class of activity is Congress seeking to regulate?" must be answered, so to rely on (3) the mandating that you and I purchase health insurance, must be an economic activity that substantially "affects interstate commerce."
Significantly, the mandate imposed by the pending bills does not regulate or prohibit the economic activity of providing or administering health insurance.

Nor does it regulate or prohibit the economic activity of providing health care, whether by doctors, hospitals, pharmaceutical companies, or other entities engaged in the business of providing a medical good or service.

Indeed, the health care mandate does not purport to regulate or prohibit activity of any kind, whether economic or noneconomic. To the contrary, it purports to "regulate" inactivity.
 Here is a tricky, but important part of this puzzle:
Proponents of the individual mandate are contending that, under its power to "regulate commerce...among the several states," Congress may regulate the doing of nothing at all! 
 You or I did not have health insurance for whatever our reasons - we did nothing at all, and Congress proposes to regulate our inactivity!
In other words, the statute purports to convert inactivity into a class of activity. By its own plain terms, the individual mandate provision regulates the absence of action. [Again, we have chosen not to buy health insurance - and by that choice, Congress says we have participated in an activity that affects interstate commerce!]
To uphold this power under its existing doctrine, the Court must conclude that an individual's failure to enter into a contract for health insurance is an activity that is "economic" in nature-- that is, it is part of a "class of activity" that "substantially affects interstate commerce." ...
 Although Congress may possibly regulate the health care industry or the health insurance industry in light of their substantial effect on interstate commerce, the individual mandate regulates the noneconomic inactivity of not purchasing a particular service or entering into a contract.
 Note this:
Never in this nation's history has the commerce power been used to require a person who does nothing to engage in economic activity. 
 A mandate to enter into a contract with an insurance company would be the first use of the Commerce Clause to universally mandate an activity by all citizens of the United States....
The health bill's individual mandate provision would have the unprecedented effect of subjecting an individual's decisions to federal control by virtue of the fact that the individual merely resides within the borders of the United States.
According to the Heritage Foundation, if Congress is allowed to get by with regulating and mandating this "class of inactivity," then they will have gained unlimited power:
Congress would have the unlimited power to regulate, prohibit, or mandate any or all activities in the United States. Such a doctrine would abolish any limit on federal power and alter the fundamental relationship of the national government to the states and the people.

Here are examples of how interestate commerce has not been used in the past:
Even in wartime, when the production of materiel is crucial to national survival, Congress has never claimed such a power.

For example, during World War II, no farmer was forced to grow food for the troops; no worker was forced to build tanks.

While the federal government encouraged the public to buy its bonds to finance the war effort, it never mandated they do so.

While Congress levied a military draft, it did so as necessary and proper to its enumerated power in Article I, sec. 8 "to raise and support armies," not its commerce power.
What Congress did not and cannot do during a wartime emergency, with national survival at stake, it cannot do in peacetime simply to avoid the political cost of raising taxes to pay for new government programs....
Simply because Congress can regulate wheat production under the Agricultural Adjustment Act does not entail that Congress can require every American to buy boxes of Shredded Wheat cereal on the grounds that, by not buying wheat cereal, non-consumers were adversely affecting the regulated wheat market.
Give Congress the power they are now seeking, and all of the above powers can be extended to them.

D) How about mandating that individuals buy car insurance? The argument that "a universal federal mandate to obtain health insurance is no different than a state requiring its licensed automobile drivers to have liability insurance for their injuries to others, is not a valid comparison.
...there are several important constitutional differences that render the comparison decidedly inapposite.
One difference is that in our republic, states have police powers that Congress does not have:
Thus, states may craft numerous regulations for the protection of their citizens which are beyond Congress' power.
The "level of insurance" required to operate within a specific state is granted by "a state' police power," "a completely different source of constitutional authority" that Congress cannot invoke.

Further:

(1) Auto insurance requirements impose a condition on the voluntary activity of driving

(2) A health insurance mandate imposes a condition on life itself [you exist and your life makes you available to mandated health care].
States do not require non-drivers, including passengers in cars with potentially bad drivers, to buy auto insurance liability policies--even though such a requirement undoubtedly would lower the auto insurance premiums for those who do drive.

The auto insurance requirement is linked to driving and to the possibility that bad driving may cause injuries to others, including passengers in the driver's car, not to those who benefit from roads generally.
(3) State auto insurance requirements are limited to those who drive on public roads.
Driving on government roads is a privilege--one easily distinguished from merely living. For those who choose to drive on public roads, the state can establish terms and conditions reasonably related to preventing injury to others.

These same rules do not extend to driving on private roads or property. Indeed, one may drive vehicles on private property without ever obtaining a state driver's license.
(4) A driver is required to provide insurance to cover the damage or injuries he/she may cause to others. The driver himself is not required to insure himself or his auto.
Thus, the auto insurance requirement covers the dangers and liabilities posed by drivers to third parties only, ...

...the driver remains free to assume the risk that she will injure herself, even if she is insolvent to pay for her own expenses.
E. An Unconstitutional Tax
Article I, section 8 of the U.S. Constitution delegates to Congress the power "To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defense and general Welfare of the United States...."
Congress' "implied power to spend tax revenues" may not be legal but there are no precedents to limit their "spending power" to only those expenditures that are necessary and proper:"
Therefore, the courts may well allow Congress to use its taxing and spending powers to craft a general income tax sufficient to pay for health care insurance for more Americans.
They may also allow grants to states to encourage them to insure more Americans.

...they may allow Congress to create tax credits for individuals who pay for their own health insurance policies.
But just because Congress may use its powers of taxation in these ways does not mean that anything it decides to call a "tax" is constitutional.
Congress would have to take the political wrath taxpayers would reign down upon them if they instituted the taxes laid out above. And this is precisely why Congress is calling the fines and penalties they plan to levy against any citizen not purchasing health care, "shared responsibility penalties," and thereby funding the their new program without calling it a tax.
It is likely that the Supreme Court will find this effort to avoid political and fiscal accountability a pretextual assertion of Congress's taxation powers and therefore, unconstitutional.
Whether it is called a "responsibility penalty," a fine or a tax, it is unconstitutional because it is not a tax on income, but a tax on the person - which is known as a "capitation tax."
 ...the Constitution requires that capitation taxes be apportioned among the states on the basis of census population.
...the health care mandate tax must be assessed evenly based upon population, and not vary based upon factors such as the financial condition of the state's residents. A state with 5 percent of the population must therefore pay 5 percent of the tax, even if its residents are disproportionately wealthy or poor as compared with other states.
 But, the Heritage Foundation says it will be impossible to meet the constitutionality required, because:
...the mandate exempts individuals who are not lawfully present in the United States. But illegal aliens have been counted in the census,...

Failure to apportion the tax to include illegal immigrants would therefore be constitutionally fatal to the tax.

The mandate also excludes taxpayers with:
...income under 100 percent of the poverty line,

individuals for whom the required contribution would exceed 8 percent of their income,

religious objectors,

incarcerated individuals,

and anyone determined to have suffered a hardship regarding their capability to obtain coverage, as determined in the discretion of the Secretary of Health and Human Services. 
 The problem is, these exceptions work within an individual income tax, but the Constitution forbids "these distinctions in capitation or direct taxes," because they "would upset apportionment on the basis of census population...."

So there you have it. I hope this has supplied a few arguments for your liberal friends, if you have any - but then we seldom argue with them do we? We're usually too polite. Two bottomlines: (1) Obama Care is unconstitutional, and (2) who takes this to the Supreme Court for us, should it be necessary?

The Shape Of Things To Come!


The Shape of Things to Come is a work of science fiction by H. G. Wells, published in 1933, which speculates on future events from 1933 until the year 2106. The book is dominated by Wells' belief in a world state as the solution to mankind's problems.

And like all dreamers, liberals actually believe the propaganda of the One World Order being a benevolent dictatorship of the elites showering down their wisdom upon the unwashed masses.

A few days ago, the so-called experts and doctors examining the costs and effectiveness of early screening for breast cancer came down from their proverbial Mount Sinai and delivered the following pronouncement:
Women in their 40s should not get routine mammograms for early detection of breast cancer, according to updated guidelines set forth by the U.S. Preventive Services Task Force.

Before having a mammogram, women ages 40 to 49 should talk to their doctors about the risks and benefits of the test, and then decide if they want to be screened, according to the task force.

For women ages 50 to 74, it recommends routine mammography screenings every two years. Risks and benefits for women age 75 and above are unknown, it said.
The U.S. Preventive Services Task Force is worried that women might get upset if they discover a lump in their breast. May have undue worry when they have their annual mammogram. It is just easier to pat the poor, dumb creatures on the head and send them back to the kitchen to cook their hubby dinner. Let the men decide what the best type of medicine you need to have.

Too bad nobody told these so-called experts that 15% of Breast Cancer survivors discovered their cancers in time by self-examination and routine mammograms.

Funny how this emerges just when Obama's health care bills have huge cost overruns in them. Strange that noone is looking to see how much money will be saved by insurance companies (especially government run ones) once they adopt these new recommendations.

But why stop with Breast Cancer. Why not continue on this idea and stop routine, yearly Pap Smears. After all, a false positive will lead to worry in that department.

Great Britain stopped Pap Smears for women under 25, and they were able to reduce costs by 10% (and increased cervical cancer deaths by 10%).

We could stop testing for Ovarian Cancer too. Why not? Not many women get Ovarian Cancer, and absolutely no men will contract the disease. According to the new ideas in Government Health Insurance, women's health doesn't really matter. So why even give the poor, defenseless things (they really cannot do much and are quite dumb about the world) yearly health exams. Once every 3 to 5 years will do better. If you let them even have that.

Oh the left talks big on equality. On Human rights. On cheep affordable Health Coverage for all. All except poor and middle class women. It is ok to let them die of a disease that is survivable if caught early and treated.

But not in the future America where the price of a test is worth infinitely more than a human life.

What Do Democrats, Bats And Cockroaches All Have In Common?


They all like to do their work in the dead of night.

Last night the House of Representatives passed Heathcare reform by a vote of 220-215.
In a victory for President Barack Obama, the Democratic-controlled House narrowly passed landmark health care legislation Saturday night to expand coverage to tens of millions who lack it and place tough new restrictions on the insurance industry. Republican opposition was nearly unanimous.

The 220-215 vote cleared the way for the Senate to begin a long-delayed debate on the issue that has come to overshadow all others in Congress.

A triumphant Speaker Nancy Pelosi likened the legislation to the passage of Social Security in 1935 and Medicare 30 years later -- and Obama issued a statement saying, "I look forward to signing it into law by the end of the year."

"It provides coverage for 96 percent of Americans. It offers everyone, regardless of health or income, the peace of mind that comes from knowing they will have access to affordable health care when they need it," said Rep. John Dingell, the 83-year-old Michigan lawmaker who has introduced national health insurance in every Congress since succeeding his father in 1955.

In the run-up to a final vote, conservatives from the two political parties joined forces to impose tough new restrictions on abortion coverage in insurance policies to be sold to many individuals and small groups. They prevailed on a roll call of 240-194.

Ironically, that only solidified support for the legislation, clearing the way for conservative Democrats to vote for it.

The legislation would require most Americans to carry insurance and provide federal subsidies to those who otherwise could not afford it. Large companies would have to offer coverage to their employees. Both consumers and companies would be slapped with penalties if they defied the government's mandates.

Insurance industry practices such as denying coverage on the basis of pre-existing medical conditions would be banned, and insurers would no longer be able to charge higher premiums on the basis of gender or medical history. In a further slap, the industry would lose its exemption from federal antitrust restrictions on price fixing and market allocation.

At its core, the measure would create a federally regulated marketplace where consumers could shop for coverage. In the bill's most controversial provision, the government would sell insurance, although the Congressional Budget Office forecasts that premiums for it would be more expensive than for policies sold by private firms.

This bill is not reform, it is socialized medicine that will bring to the United States the same horror that Great Britain and Canada now have. It will destroy the private option, giving every citizen not the best healthcare in the world, but the worse health care in the world.

But that doesn't concern the Congress, they have exempted themselves, government employees, and the unions from this bill. But for the rest of us, either we get insurance, or we face a fine of $250,000 and/or 5 years in prison.

Too bad if you cannot afford insurance, you have to take the government option. You know, the one that won't allow you to join for 6 months if you have a pre-existing condition. Insists on having you go before a Death Panel to get benefits. And without any guarantees that you get to keep your own doctor.

This bill will cost Billions of Dollars, taxes that take effect immediately, but the bill's health care plan does not go into effect until 2013.

Too bad for all those people who are being denied Health Care for pre-existing conditions right now. They will have to wait until this bill goes into effect, so either they die, pay for health care out of their pocket, or wait (if they can). In the meantime we all will be taxed for services not yet given.

Any bets that Congress spends that money right away on frivolous pork projects?

The Tome Of Health


Book of Obama: Chapter 8

In the time of heat when tempers run thin, He came down from on high with His plan to solve the crises of health.

Like Moses of old, He stood upon the mountain top with the Tome of Health and said:
"I bring unto you the cure for all. Do not read it, just pass it. I command thee to do!"

The multitude of the land looked upon Him and His Tome of Health and whispered:

No we won't.

The Anointed One was not dismayed. He turned to Pelosi the Loud and Reid the Tired told them to gather the troops and force the multitude to love His plan.

So they went forth, the Democrats armed with the Sword of Union and the Shield of Acorn. They went forth to do battle with the multitudes who sat down and read the Tome of Health.

And the multitude cried:

No we won't!

This started to dismay the Democrats and they cried out to The One: "Oh Great Leader, Anointed One, help us along! For no longer is our shield and sword working. At meetings of towns and villages they are not effective. The more we call the multitude names, the louder their cries become.

They have read the Tome of Health and do not like what they have read. A single payer, public option is not what they want or desire. Yet it is Your wish, Anointed One, and Thy will be done. Though it will cost us the election in 2010.

And the multitude screamed:

No We Won't!

The Anointed One let out a sigh. "I will see to it. I will attend the towns in Hampshire the New and in the Mountains of Montana. There I will convince the multitude to accept the Tome of Health."

And there was great rejoicing amongst the Democrats.

He took up the Sword of Union and Shield of Acorn and journeyed to Hampshire the New. With His loyal follower comprising of the congregation He presented The Tome. All was working according to plan, even the young child's question brought the press to His side.

Off to the Mountains of Montana, His stride was upbeat, then came the cries of fowl for the multitude had discovered the child who spoke her question was a weed. The child's mother worked for Him, wrote out her question too. All His hard work was not going to help at all. The Sword of Union was dull and rusty. The Shield of Acorn was corrupt and coming apart at the seams.

Outside the hall the multitude was screaming:

No We Won't!

He went on to the Vineyard of Martha with His wife and two children. A happy vacation was not on the menu. All through the heat of the Summer in villages and towns, the multitude fought hard and the Democrats were on the run.

Just when things looked bleak, His Presidency a failure, a miracle occurred. Teddy the Lecher, of Camelot fame, the author of the Tome, died and became the rallying cry of them all.

For Teddy we will do it! Pelosi the Loud proclaimed. We will ram it through the Congress, and call it by his name. Teddy's bill it is now called. Soon to become law. For the Lecher they will do it, and disregard the multitude once and for all.

This will save My Presidency! The Anointed One exclaimed. Let Us exalt our dear Teddy who has saved the day.

Through out the land a rumbling was heard. From the cities, towns and villages it was felt by all.

Who cares what the multitude thinks cried the Democrats. We have the votes, the will and Teddy's Bill will pass. What can you do? You are nothing but a voice. You have no power. This is our choice.

But the rumbling did not die. For the multitude had become a great voice. They stood on the mountain tops and in a loud voice:

There is much we can do. We are not alone. We have a great voice. You have won this battle, but the war is not lost. We will organize, become stronger. Then you will have to listen to our voice.

The Democrats just laughed. You are racists, and bores. We have The Anointed One leading us, He has given us Hope and Change. You have nothing at all.

But the multitude had seen the signs. His approval ratings were dropping, they knew He couldn't last. With a loud voice they screamed so the whole world would hear:

YES WE CAN!
JUST WAIT UNTIL NOVEMBER 2010!!!

Marine Veteran at Rep. Baird's Townhall

David Hedrick is a Marine Vet who had an important lesson for Congressman Brian Baird (D-WA) at his recent Townhall gathering. This is the lesson for politicians of both parties. See video below.

God bless David Hedrick for serving our country and explaining the commitment to the U.S. Constitution to those privileged to serve us in Congress, in this case, Brian Baird.

Watch as Conservatives cheer, but many, many Liberals remain seated. What is it that they did not get from David's message. How ignorant can a voter be?

Articles in multiple news sources today quote Baird’s expression of fear as he states, “extremists would have the chance to shout and make YouTube videos.”

In that regard, Baird then said, “What we’re seeing right now is close to Brown Shirt tactics. I mean that very seriously.”

Brown shirts, I’m sure you recall were a paramilitary organization of Germany’s Nazi Party that played a key role in Adolf Hitler’s rise to power in the 1920s and 1930s.

Instead of addressing constituents real and honest concerns over the proposed healthcare reform, he labels us Nazi’s, then ducks and hides.

Did we elect him for this? No!

In announcing a “secret schedule” for a telephone conference in lieu of a Town hall, should you be fortunate enough to be invited and actually be by your phone if called, Baird said, “There is this national movement in blogs and on the Internet to go to town hall meetings solely to attack people. One colleague of mine recently was hung in effigy at a town hall meeting. Others needed police escorts.”

Seems I recall no concerns over protesters who disrupted Town halls of Republicans around the country and liberals even applauded an Iraqi throwing a shoe at President Bush at a news conference there.

Brian, if it didn’t cross your mind, voters can hang you in effigy any time. We don’t need a town hall for that. That is what effigy is, an expression of opposition without causing any harm to the individual.

Then again, wasn’t hanging Sarah Palin in effigy during last years campaign an “expression of free speech?”

Civics 101

Schools today do not teach the subject Civics. The requirements and responsibilities of citizens. I have no idea what they teach instead, but they need to return to teaching civics, and the history of politics and the political parties once again.

I know that the study of Civics is forgotten by American schools, due to the fact that too many young people are woefully ignorant of their civic responsibilities and the history of the political parties.

Barack Obama: the best thing to happen to America

No, no! I really have NOT lost my mind. Bear with me. Barack Obama may just be the best thing to happen in a generation for a number of reasons. In the many years I have been watching American politics - from a distance - he has done more to engage, awaken the American people than any other president. Oh sure, when George W. Bush was in office, certain pockets of America were afflicted with Bush Derangement Syndrome, which perpetuated oft-repeated demonstrations and slogans: Bush Lied, They Died; or No War for Oil, blah blah, followed by 'all in good fun and taste' posters that made any decent person cringe. Mostly though, while the fringe elements (aided and abetted by the mainstream media, of course,) were making asses of themselves, regular Americans were busy raising their families, earning a living, pretty much secure in the knowledge that America was safe from outside attacks.

Now we have Obama, and I see a conscious decision on the part of many Americans to be engaged in the protection of their country, that I had not witnessed before. Yes, I also see a huge divisiveness since the election of the silver-tongued senator who promised to unite America. This community organiser, who campaigned on the slogans of "Change yoiu can Believe in" and "Yes, we can!" is discovering that Americans who feel the most basic fabric of their country under threat, are not willing to sit idly by, and allow ANYONE, foreign or domestic, to tear apart the communities that ARE America.

After many years of watching America the beautiful on the world stage, I now see an underbelly of America that is ugly, with a president who travels the world in fine style (what about the carbon foot print?) and apologies to the world for the stellar reputation that America has enjoyed as a leader.

Now is not the time for couch potato politics, but for each and every one of us to get involved and active.

It is the time to remind our "Elected Officials" that they work for us, we don't work for them.

It is the time to teach Barack Obama, Nancy Pelosi, and the other leaders of the Democratic Party that dissent is not treason.

It is the time to stop fearing our government, but have the government fear us.

It is the time to prevent the Tyranny of the Democratic Party from destroying our nation, our liberties, our rights.
